General terms of sale

Introduction

Arteum Services is the service provider for Société d'Exploitation de la tour Eiffel in the sale on line of products.

These Terms of Sale are agreed between Arteum Services SAS with € 100 000 share capital, no. 808 799 704 in the Paris Commercial Register - Registered office: 10 rue du mail - 75002 Paris (hereafter "Arteum") telephone: 01 84 16 17 52, the party of the first part, and the persons wishing to make a purchase through the e-shop (hereafter the "User"), the party of the second part.

Purpose

These terms and conditions set out the terms of: sale between Arteum Services and the User; order placement via Customer Service; and of payment and delivery.

Orders

Orders placed on-line remotely create a contract between the customer and the e-shop and constitute irrevocable acceptance without restriction or reserve by the User of the General Terms of Sale.

In order to ensure that the User understands the product he wishes to purchase before he actually places an order, the site shows the main features of the product offered for sale, including specifications, illustrations and indications, dimensions and weight. Product selection and purchase is at the User's total liability.

Orders indicate acceptance of the price and of the description of the product offered for sale. The User may alter his basket before final validation, which completes the contract of sale between Arteum Services and the User.

Arteum Services shall honour all orders received through the website so long as stocks of the products are available. If the product is no longer available, Arteum Services shall inform the User. Sales are not completed until the e-shop has emailed the User confirmation of order acceptance and has received the full price.

Prices and terms of payment

Prices are shown in euro on the website and include tax (for sales to France and the European Union, this includes VAT at the rate applying at the order date).

The product to be sold shall be billed at the price applying when the User validates the order. The price indicated when the order is placed and is confirmed by the website shall be the final price. The product shall be offered for sale while it appears on the website, subject to availability. The e-shop and its supplier reserve the right to alter prices at any time.
When placing their orders, Users are advised to check that the product price is the price shown on the up-to-date version of the website and not on an expired page they may have accessed by searching the internet in cached mode.

The data sent by the User and registered by the website when the order is placed constitutes proof of a transaction between the e-shop and the User. Once the User has validated the order, the e-shop shall send the User a confirmation e-mail to inform him that the order has been registered.

The price of purchased products is payable in cash and in full at order by the User. The e-shop will not deliver any products ordered by the User unless it has received full payment for the products. Title to products shall be transferred to the User upon full payment of the price. The transfer of risk of product loss and damage shall be made upon delivery and acceptance of the products by the User.

Terms of payment

The User may pay for purchases:

  • on-line by: Carte Bleue, Visa, MasterCard

The User's account shall be debited when the order is placed. If products are out of stock or unavailable, the customer shall be e-mailed an offer of refund.
Refund shall be made within the statutory one-month period following receipt of the customer's RIB (bank details).

  • on-line through your PAYPAL account:

If you decide to pay by PayPal you will be automatically directed to your PayPal account. Once your PayPal payment has been validated, you will have completed your on-line order. If products are out of stock or unavailable, the customer shall be e-mailed an offer of refund.
Refund shall be made within the statutory one-month period following receipt of the customer's RIB (bank details).

Delivery

Purchased products shall be delivered in the stated time of between 5 and thirty days of order to the address given by the User when placing the order on-line.
After this time and unless in the event of force majeure, the User may request cancellation of the sale pursuant to article L. 216-2 Consumer Code, with refund of all amounts paid at the sale.

Except in exceptional circumstances or if any one or more items are unavailable, products ordered shall be delivered together by an independent carrier. In accordance with Articles L.217-4 to L.217-14 of the Consumer Code and Article 1641 of the Civil Code, all products offered for sale on the site have a legal guarantee of conformity (24 months) and a guarantee of hidden defects.
Thus, the user has a period of 2 years from delivery to train, by registered mail addressed to
Service Web Arteum, 10 rue du mail, 75002 Paris or to e-mail contact@arteum.com with reservations or complaints about delivered products that are incorrect or have obvious defects, and including all relevant evidence. After this period, and so long as all formalities have been completed, the products shall be considered correct and free from all obvious defects and the e-shop will no longer accept any complaints.

The e-shop shall immediately and at its own expense replace any delivered product with visible defects or that is incorrect, as proved by the User. In the event of delivery error, incorrect products must be returned in their entirety and in their original packing along with the delivery note to:

Incorrect products for which replacements are not available shall be refunded automatically within thirty days of payment by the customer. The e-shop shall pay for the shipment and return of incorrect products.

Change of mind/returns

Consumers shall have fourteen clear days in which to exercise their right to change their mind without giving reasons and without any penalties other than return costs.

Products that are broken at delivery must be identified and declared at delivery and reported to the carrier.

Customers should e-mail Arteum Customer Service at contact@arteum.com with photographs of the product.

Arteum Services shall then replace the merchandise.

Data protection

The information contained in the User's order will be processed automatically.
Pursuant to Law 78-17 of 6 January 1978, the personal data requested from customers is needed to process their orders and will be used for internal e-shop purposes. The same personal data may however also be sent to third-party partners of the e-shop. The User has a legal right to access, amend and correct the information that concerns him through the My Account section on the website and to challenge that information by telephoning Customer Service on 01 84 16 17 52 or e-mailing contact@arteum.com
The purpose of the automatic data processing is to analyse transactions and fight credit and debit card fraud. The e-shop may request documentary proof from the customer (identity card in the name of the card holder, proof of address, etc.). If the customer refuses to provide any of these documents or this information, the e-shop shall cancel the order and refund the price of the product.

In the event of non-payment because of fraudulent use of a credit or debit card, or of incorrect or untrue declarations by the customer, the details given for the order concerned shall be recorded in a default on payment file kept by the e-shop.

Applicable law - disputes

This contract is governed by French law. Disputes concerning the validity, interpretation, implementation or cancellation of the contract and their consequences and outcomes shall be heard by the competent courts in accordance with ordinary law.
